This session will examine the Wikimedia Foundation's Defensive Litigation efforts, which are designed to protect the Wikimedia projects, contributors, and content from legal threats across jurisdictions. As legal demands grow more complex and extraterritorial in nature, the Foundation remains committed to safeguarding contributor rights while complying with applicable legal obligations. The session will outline key legal principles guiding the Foundation's approach, address the limitations imposed by procedural laws, and provide an opportunity to clarify questions the Community may have regarding recent litigation-related matters. The objective is to strengthen trust through transparency and reaffirm the Foundation's continued dedication to defending the Wikimedia projects and the communities that sustain them.

Description

For over two decades, the Wikimedia movement has worked tirelessly to advance free and open knowledge across the world. The Wikimedia Foundation plays a vital role in supporting this mission, i.e., by maintaining infrastructure, advocating for sound internet policies, and defending the projects, contributors, and content in legal proceedings.

As the internet has become a universal enabler of education and the global flow of information, governments and private actors have increasingly sought to regulate, restrict, or influence online platforms, often invoking national security or public interest. Many jurisdictions now assert extraterritorial legal authority, with courts issuing orders impacting foreign-incorporated platforms. This evolving legal landscape presents new challenges for global platforms like Wikipedia.

While the Foundation remains firmly committed to protecting the Wikimedia Community, it is no longer a binary choice for it to refuse to comply with enforceable legal orders. Doing so could put the Foundation at risk of contempt, limiting its ability to defend the projects or Community that makes them possible. That said, the Foundation's litigation strategies continue to be anchored in the principle that protecting the rights of contributors to participate, speak, and collaborate freely is paramount without compromising their privacy.

However, there are times when legal customs, local procedural restrictions or strategic compulsions limit the extent to which the Foundation can share details with the Community. We recognize that this challenge, though often legally required, can give rise to concerns or misperceptions about whether the Foundation is upholding its values.

Unlike many other platforms, the Foundation actively resists legal demands that threaten contributor privacy, editorial independence, or free expression. It does so within the boundaries of law, and has secured favorable outcomes in several challenging legal environments.

This session aims to: -Provide an overview of emerging legal trends affecting Wikipedia, such as dynamic injunctions, content liability regimes, defamation standards, and jurisdictional overreach. -Offer insight into the limitations the Foundation faces when litigating in foreign jurisdictions or complying with legally binding orders. -Explore the opportunities for more effective communication and collaboration between the Foundation and the Community in matters involving legal risk. -Invite questions from contributors, and address litigation-related concerns to the extent permissible under applicable law.
