Wiki Loves Monuments And Freedom Of Panorama: The Case Of Italy
“Wiki loves monuments” is having troubles in Italy because in that country the freedom of panorama is not recognised by legislation.
As a matter of fact, it is necessary to request prior authorisation, in order to be able to take pictures of a monument. Although Italy has a huge monumental heritage, participants in the competition actually have the opportunity to take pictures of only a small number of monument. In 2015 a bill was presented to introduce freedom of panorama in the European legal system but since then the text of the bill has been hijacked in the direction of the ban of taking and publishing photos of palaces and monuments in the whole European Union.
The bill has not been approved and therefore in the current situation there is gap between the vert liberal legislation of countries as the United Kingdom and the proihibitionist legislation of countries like Italy, restricts the freedom of taking pictures even of monuments exposed to the public view.
Wikimedia projects respect the legal rules of the different countries, while more generally users of the social networks publish freeely their photos, although violating the legal constraints they are often not aware of.
Contributions of “Wiki loves monuments” often face difficulties in explaining to photographers that they can not publish their photos because there is the need for a written permission by the owner of the monument. A the same time institutions, like municipalities, museums, diocese or private are not aware of the aspects of the law, do not understand the benefits of “freeing” the monuments and are unwilling to grant authorizations.
This session will address the conference theme — Wikimedia, Free Knowledge and the Sustainable Development Goals — in the following manner:

Making the other communities aware of the troubles we have is a first step. Maybe we can get useful tips to overcome this legislation or to increase participation in the competition.
